What will your last meal be? ? Eyes on Estate Planning

Posted on by robinsonandmiller

??By: Nicole McNair

Don?t be left as a ghost with unfinished business this Halloween.? Now is the time to think about getting your estate in order.? All Hallows? Eve is a blunt reminder there will not always be tomorrow.?

Even if you do not consider yourself to be wealthy, you still need to have a strategy in place. You may not need tax planning (which many people confuse with estate planning), but everyone needs a basic estate plan, which includes a Will, Financial Power of Attorney, and Advance Directive for Healthcare.? To have the correct line of defense set up in the event of a Gruesome Incident that leaves you incapacitated, you should designate a medium to decide how your assets and your health will be managed (and by whom) for your benefit during your lifetime. Estate planning allows you to allocate how, who, and when your assets will be transferred to your loved ones at your death.? If the Grim Reaper claims you as his latest Victim, prevent your estate from meeting the same fate.

Brainwave training boosts network for cognitive control and affects mind-wandering

ScienceDaily (Oct. 24, 2012) ? A breakthrough study conducted in Canada has found that training of the well-known brainwave in humans, the alpha rhythm, enhances a brain network responsible for cognitive-control. The training technique, termed neurofeedback, is being considered as a promising new method for restoring brain function in mental disorders. Using several neuroimaging methods, a team of researchers at the Western University and the Lawson Health Research Institute have now uncovered that functional changes within a key brain network occur directly after a 30-minute session of noninvasive, neural-based training. Dysfunction of this cognitive-control network has previously been implicated in a range of brain disorders including attention deficit hyperactivity disorder, schizophrenia, depression and post-traumatic stress disorder.

During neurofeedback, users learn to control their own brain activity with the help of a brain-computer interface. In the simplest case, this consists of a computer that records brainwaves through surface sensors on the scalp, known as an EEG (electroencephalogram). The system is then able to process and simultaneously represent a user's real-time brain activity, displayed from moment-to-moment during a training game on a computer. This setup is known as a neurofeedback loop, because information of brain activity is continually fed-back to a user reflecting their level of control. Such real-time feedback allows users to reproduce distinct brain states under physiologically-normal conditions, promising to be an innovative way to foster brain changes without adverse effects. This is possible because of neuroplasticity, a natural property of the brain that enables it to reorganise after continual training, resulting from adjustments to its own activity.

The new findings firstly help to address a long-standing issue in the field: whether neurofeedback training can trigger any brain changes at all? "The effects we observed were durable enough to be detected with functional MRI up to 30 minutes after a session of neurofeedback which allowed us to compare brain and behavioral measures more closely in time," says Tomas Ros, PhD, lead author of the study, now at University of Geneva. "We were excited to find that increased metabolic coupling within a key cognitive network was reflected in the individual level of brainwave change provoked by neurofeedback. The same measures were found to be tightly correlated with reductions in mind-wandering during an attention task. Amazingly, this would imply that the brain's function may be entrained in a direction that is more attentive and quiet. In other words, our findings speak for the exquisite functional plasticity of the adult brain, whose past activity of little more than 30 minutes ago can condition its future state of processing. This has already been hinted at in meditation research, but we arrived at a direct and explicit demonstration by harnessing a brain-computer interface."

Senior author Dr. Ruth Lanius, a professor in the Department of Psychiatry at Western's Schulich School of Medicine & Dentistry and a scientist with Lawson Health Research Institute adds: "Compared to the lack of significant findings in the control group that received training with false feedback, our findings are unambiguously supportive of a direct and plastic impact of neurofeedback on a central cognitive-control network, suggesting a promising basis for its use to treat cognitive disorders. We hope that our observations will stimulate more research by the science community in order to fully evaluate EEG neurofeedback as a viable and potentially revolutionary approach for the treatment of brain disorders. We are very excited by this promise and anticipate a host of new studies in this direction, particularly for cognitive disorders. Our current work has now moved into the clinical domain to examine whether patients with post-traumatic stress disorder may benefit from this advance." The study was directed by Lanius and Dr. Jean Theberge.

(AP) ? Friends, family and former colleagues paused before the flag-draped casket of former U.S. Sen. George McGovern on Thursday to pay tribute to the liberal Democrat who ran for president against Richard Nixon and lost and who later became a champion in the fight against global hunger.

About two dozen people lined up outside the First United Methodist Church in Sioux Falls before the start of the public viewing and prayer service for McGovern, who died Sunday at age 90. His funeral is Friday.

Vice President Joe Biden, who served alongside McGovern in the Senate in the 1970s and early '80s, was among the confirmed guests expected to attend Thursday.

"I was honored to serve with him, to know him and to call him a friend. ... Above all, George McGovern was a generous, kind, honorable man," Biden said Sunday in an emailed statement after McGovern's death.

The two days of remembrance for the staunch liberal will include some of South Dakota's highest ranking officials from both sides of the political spectrum. Sen. John Thune, Rep. Kristi Noem and South Dakota Gov. Dennis Daugaard, all Republicans, have confirmed they plan to attend. Sen. Tim Johnson, D-S.D., is scheduled to speak at the 6:30 p.m. Thursday prayer service.

It isn't yet clear who will speak Friday at the funeral inside the Mary Sommervold Hall, which seats 1,800 people. McGovern family spokesman Steve Hildebrand said the family will not announce who is attending.

It's possible that former President Bill Clinton and former Republican presidential candidate and U.S. Sen. Bob Dole could attend. Clinton and his wife, Secretary of State Hillary Rodham Clinton, met McGovern while campaigning for him in 1972 and remained friends. Bill Clinton later appointed McGovern as ambassador to the United Nations' food and agriculture agency and awarded him the Presidential Medal of Freedom, the country's highest civilian honor.

McGovern later was appointed to be the first UN Global Ambassador on World Hunger. Dole and McGovern co-founded the Food for Education program for children in poverty-stricken countries.

McGovern, who railed against the Vietnam War as a senator and later lost his 1972 presidential bid to Republican Richard M. Nixon in a historic landslide, is to be buried at a later date at Rock Creek Cemetery in Washington, D.C.

Sioux Falls business managers are preparing for an influx of customers, though they don't know just how many.

Tiffany Semmler, a manager at Minervas Restaurant, a few blocks from the site of the funeral, is bracing for a busy Friday.

"You never know if people are coming from out of town and going directly to the funeral, we might not get an excessively busy lunch. If they decide to go directly home after the funeral, we won't get a big push after the funeral," she said, noting that the restaurant is planning to schedule an additional server and cook.

"If everyone stays in town and isn't going back to work on Friday, we could get hit really hard," she said.

At least one hotel is offering a discount for those attending the funeral of McGovern, who was born in Avon and grew up in Mitchell.

The executive director of the Sioux Falls Regional Airport bets most out-of-towners will be driving. Pheasant hunting season opened last weekend, said Dan Letellier, and the airport's 23 daily flights Thursday and Friday are already booked.

"Any national figure or business leaders from other parts of the country may very well end up chartering flights or corporate jets," he said.

More Minorities Become Franchise Operators

DULLES, Va.?Peter J. Berberena yearned to have his own business since he was a teenager waiting tables at a Denny?s restaurant in Hato Rey, Puerto Rico. He just didn?t know that it would be selling cell-phone cases with the imprimatur of Hello Kitty or Justin Bieber.

?Who in the world do you know that doesn?t have a cell phone?? teases Berberena, 39, at his kiosk at the Dulles Town Center in Northern Virginia. ?Some people have two.?

Nor did he ever imagine his business would be a franchise.

Berberena is part of a growing number of minority entrepreneurs who see the franchise model as a way to build family wealth. While an overall census of black, Hispanic, and Asian-American franchisees is not available, anecdotal data from two industry organizations suggest these types of enterprises are on an uptick.

A 2007 report by the World Franchising Network found that minority ownership increased 1.2 percentage points to?20.5 percent?between 2000 and 2007. The National Minority Franchising Initiative published a more conservative figure earlier this month (16 percent), along with a list of the 50 top franchises with minority senior management or ownership.

In the late 1990s, Berberena began working for a cell-phone accessory company, helping to open four stores in Las Vegas. About four years ago, he joined the same company with business partner Chris Whipple, who has Ethiopian roots. Together, they pooled $25,000 to secure a Cellairis franchise.

They now have two Cellairis franchises in Virginia and Maryland. And Berberena hopes the $63 billion-a-year market for mobile-phone accessories will help him expand. ?Thank God for the iPhone,? Berberena exclaims.

Berberena projects his sales to be $20,000 to $25,000 from January to October and $30,000 to $40,000 during the holiday season that starts in November. He has four employees.

Overall, minority-owned businesses have increased. Black-owned businesses increased by 60 percent to 1.9 million between 2002 and 2007, with sales receipts totaling more than $137.5 billion, latest census?figures show. Similarly, businesses owned by Asian-Americans grew by?40 percent. Hispanics, the largest minority group, are starting small businesses at twice the rate of the national average.

As the country?s population continues to change rapidly, blacks, Latinos, and Asian-Americans are projected to become a powerful economic bloc. Their combined purchasing power, estimated at?$1.6 trillion in 2010, is expected to increase to $2.1 trillion by 2015. Hispanic purchasing power alone is worth $1 trillion, and expected to grow 50 percent in the next five years.

Stan Friedman, first vice chair of the Diversity Institute of the International Franchise Association, expects minority enterprises, fueled by the Hispanic and Asian population boom, fertility rates, and immigration, will spark the nation?s economy.

Lower costs to acquire a franchise license have made these enterprises more accessible. ?The days when you needed half a million dollars [to join a franchise] have changed, especially with service industries,? says Willan Johnson, a franchisor and CEO of VivoPools, which operates in five states. ?You can get in for much smaller amounts.?

The initial cost to open a Vivo Pools outlet, for instance, is $20,000, plus another $8,000 for supplies such as chemicals and cleaning accessories.

A surge in loans backed by the Small Business Administration also has given franchisees additional oomph. During fiscal year 2011, the federal agency approved more than?$19 million?in loans, most of them 7(a), a type of loan generally used for franchises.

?You?re also seeing more participation in some forms of lending,? says Johnson, who entered the franchise pool-maintenance business in 2010 after identifying a need in California?s San Fernando Valley. Then, he says, the pool industry was fragmented. Pool cleaners were undercutting each other. ?The satisfaction was quite low.?

His first franchisee was Southern Californian Richard Figueroa, who had independently maintained pools for years. ?He?s incredibly ambitious. He soaks up the knowledge and is so customer-focused,? Johnson says. Figueroa started with 160 accounts and has added 50 since joining Vivo half a year ago, Johnson adds.

Of the seven Vivo Pools franchisees, four of them are people of color.

Johnson says that minority entrepreneurs often are set apart by their whatever-it-takes-to-succeed attitude. ?There?s a strong focus on the customer that I may not see from a nonminority. They?re very vested in wanting to build a relationship,? he says.

They?re also more likely to encourage their friends and family to join the franchise, Johnson says. ?Richard tells me, ?My father wants to become a franchisee. He sees how well I?m doing ? and he wants to be part of that.??

Trinity Mirror hit by phone hacking claims

LONDON (Reuters) - Around 17 million pounds ($27.26 million) was wiped off the value of Trinity Mirror after a phone hacking scandal spread to the owner of the British tabloid Daily Mirror.

On Monday the lawyer who handled many of those phone-hacking cases filed legal claims against Trinity Mirror on behalf of four people, including the former England soccer manager Sven-Goran Eriksson.

The reputation of British journalism was rocked by the revelation of hacking by journalists at Rupert Murdoch's now defunct News of the World into voicemails of celebrities, politicians and even crime victims.

Trinity Mirror said in a statement it had yet to receive any claims, and it repeated assurances that its journalists worked within the law.

"We have not yet received any claims nor have we been provided with any substantiation for those claims," Trinity Mirror said in a statement.

Shares in the group were down 9.4 percent at 1221 GMT as investors digested the threat of increasing legal costs and damage to the reputation of a group that is already grappling with falling advertising and circulation revenues.

News International has settled dozens of civil cases, paying tens of millions of pounds, and its journalists are still facing criminal charges over the allegations that its staff routinely hacked into voicemail messages to generate salacious stories.

Billions of dollars were wiped off the value of Murdoch's News Corp at the height of the scandal last year and executives were forced to step down.

Singer analyst Johnathan Barrett said the legal claims would weigh on Trinity Mirror's share price because although the number of claims was small compared with News International, they could rise over time.

The legal action will also provide a stiff test to the group's new chief executive Simon Fox, who joined the publisher in September and to Piers Morgan, a former Daily Mirror editor who is now a CNN talk-show host in the United States.

The claims allege phone hacking took place at the Daily Mirror when Morgan, who previously edited Murdoch's News of the World, was editor.

Morgan has denied authorising phone hacking during his time as editor of the Mirror, most recently at the Leveson Inquiry, which was set up to investigate the conduct of the press. It is due to report in the coming weeks and is expected to heavily criticise the British media.

The other three claimants are Abbie Gibson, a former nanny for the family of soccer player David Beckham, soccer player Garry Flitcroft and actress Shobna Gulati.

Hear the whale that talked like a human

U.S. Navy

The white whale known as NOC used its nasal passages to make humanlike sounds.

By Alan Boyle

The noise sounds like the kind of "dum-diddy-dah" tune folks might sing to themselves while they're strolling along the beach?? but it's actually the voice of a white beluga whale, mimicking human conversation by blurping air through its blowhole.?The strange case of the whale named NOC marks the first time that scientists could study a marine mammal in the very act of "talking" like a human, using a most unhuman method.

"I think he was looking for feedback," Sam Ridgway, president of the National Marine Mammal Foundation, told me. "These animals make a lot of sound, and they like feedback."

For years, NOC was part of the U.S. Navy's Marine Mammal Program in San Diego, which was aimed at studying whether whales, dolphins, seals and other marine mammals could do underwater reconnaissance or perhaps even disable mines. NOC was captured in 1977 in Canada's Hudson Bay and brought down to California to work with researchers and divers. (He was the smallest of the pack, and Ridgway says that led to the nickname "no-see-um," or NO-C for short.)

Seven years later, the researchers noticed that NOC spontaneously started making unusual sounds ??"as if two people were conversing in the distance just out of range for our understanding," they reported in the journal Current Biology. One time, a diver came to the surface outside NOC's enclosure and asked his colleagues, "Who told me to get out?" They soon concluded it was the whale, which must have been saying "Out, out, out."

That led Ridgway and other researchers to make a series of recordings of NOC's sounds, at the surface and underwater. They found that the pitch and the amplitude rhythm was similar to human speech. "Whale voice prints were similar to human voice and unlike the whale's usual sounds," Ridgway said in a news release. "The sounds we heard were clearly an example of vocal learning by the white whale."

A team of marine biologists from San Diego are saying the audio recordings of a white whale named Noc, which they studied for three decades, prove he had the unique ability to lower his pitch to mimic the sounds of human voices. NBC's Mara Schiavocampo reports.

Although this was way out of the norm for whales, it's not unheard of: Back in the 1940s, biologists reported that whale calls could occasionally sound like the voices of children shouting in the distance. In the 1970s, there was a beluga whale at the Vancouver Aquarium that could reportedly make sounds like garbled Russian or Chinese, and even say his name ("Lugosi"). However, NOC afforded the first opportunity to study scientifically how a whale could make such sounds.

The San Diego researchers hooked up pressure sensors inside and just above NOC's nasal cavity. The readings suggested that the whale varied the air pressure inside the nasal tract, expelling air through vibrating phonic lips to make the kinds of sounds that come from a human's vocal cords. In short, the whale had figured out an alien way to talk like a human.

"We do not claim that our whale was a good mimic compared to such well-known mimics as parrots or mynah birds," the researchers write. "However, the sonic behavior we observed is an example of vocal learning by the white whale. It seems likely that NOC's close association with humans played a role in how often he employed his human voice, as well as in its quality."

About four years after NOC started talking like a human, he stopped. The whale continued to vocalize, but those sounds were just the typical whistles, squawks, rasps, yelps and barks. In 1999, NOC died. "We never got his best speech imitation" on tape, Ridgway said ? but the existing recordings were more than enough to set the researcher thinking about the potential.

"Whether or not the whale knows what he's saying, other than mimicking what he heard, probably should be explored further," Ridgway told me. "Certainly I think there's a lot we could learn about their sound production. What we'd like, primarily, is for them to tell us how they interact with their ocean environment. How deep can you dive? How long can you stay underwater? What frequencies can you hear? Can you hear the same sounds at the surface and at depth? Describe what you observe with your sonar."

Japanese researchers are already working on a dolphin speech translator. Maybe a talking whale isn't that far behind. But what would the dolphins and the whales tell us? "Thanks for all the fish"? Or "thanks for nothing, you damn dirty humans"?

More about animal intelligence:

In addition to Ridgway, the authors of "Spontaneous Human Speech Mimicry by a Cetacean" include Donald Carder, Michelle Jeffries and Mark Todd.

Review: Airberlin Business Class

By David Armstrong

It takes 11 hours to fly nonstop from Los Angeles International Airport (LAX) to Berlin?s Tegel Airport, and about 11 and a half hours to return to LAX against prevailing winds. That?s a long time to be airborne, so of course being comfortable counts.

Until it completes taking delivery of 18 Boeing 787-8s it has on order (and potentially five more, which it has optioned), Airberlin?s primary long-haul fleet type is the Airbus A330-200

?

Airberlin (IATA code AB) proved to be just the ticket when I flew in Business Class from Los Angeles to Berlin and back on a business trip in the first week of October.

It was my first trip on Airberlin. Founded in 1979 with hubs in Berlin and Dusseldorf, it is the second-largest airline in Germany.

Airberlin ? the airline styles its name as airberlin ? made a very good first impression on this frequent flier in spite of the inconveniences of using woefully overcrowded Berlin-Tegel Airport (IATA code TXL).

Tegel is scheduled for demolition when the oft-delayed Berlin Brandenburg Airport Willy Brandt (IATA code BER) finally opens next to Sch?nefeld Airport, which will be shut down. The fourth and latest opening date is October 27, 2013.

This photograph shows a line-up of four of Airberlin?s Airbus A330s at one of its major hubs, either Berlin or Dusseldorf

?

Until then, Airberlin will have to make do with Tegel, in circumstances beyond its control. Among them are sharing a small, nondescript passenger lounge in Terminal B with oneworld partner British Airways, and using functional but no-frills Terminal C for some flights.

Airberlin will have a major presence at Berlin Brandenburg when it opens next year. In the meantime, some travelers might be tempted to book away from Airberlin, but that would be a mistake.

It is a well-run, passenger-friendly, forward-looking airline, known in Europe for affordable fares, though it does not bill itself as a low-cost carrier.

Airberlin flies to seven U.S. destinations: New York JFK, Chicago O?Hare (from March 2013), Fort Myers in Florida, Las Vegas, Los Angeles, Miami, and, in summer, San Francisco.

Air Berlin began three-times weekly service between Berlin and Los Angeles on May 11, 2012, using Airbus A330-200s. The carrier?s inaugural Berlin-Los Angeles flight was met at Los Angeles International Airport with a traditional water-cannon salute from airport fire-department vehicles

?

Like everyone, I like creature comforts while flying on long-haul routes, and Airberlin is not short of those in the areas it controls directly: passenger seats, food and drink, in-flight entertainment, the quality of its fleet, interior cabin design.

Most important, though, is the caliber of staff, and here Airberlin excels. It showcased witty, personable and smart cabin crews on both my transatlantic flights.

Thanks mainly to the engaging, can-do attitude of staff, Airberlin plays a role vis-?-vis its major rival, Lufthansa, roughly analogous to the role Virgin Atlantic Airways plays vis-?-vis BA: that of a smaller, younger, rising airline taking on a much-larger, long-established ? and high-quality ? flag carrier.

(Editor?s note: Airberlin is, however, a much larger airline than is Virgin Atlantic Airways. In addition to Airberlin?s long-haul network, it has a major short-to-medium-haul network and a large fleet of single-aisle aircraft, whereas Virgin Atlantic has virtually no short-haul operations.)

The flight attendants on our reviewer?s long-haul flights in Business Class on Airberlin were witty, personable and smart

?

I wasn?t able to use Web check-in, as www.airberlin.com doesn?t allow online check-in for flights to and from the United States, but my airport check-in at LAX went smoothly. Business Class passengers can check-in two bags, each weighing up to 32 kilograms (70.5 pounds), free of charge.

My departing flight began in the Business Class lounge that Airberlin shares in LAX?s Tom Bradley International Terminal with oneworld partner Qantas Airways. The Aussie carrier operates one of the best passenger departure lounges I?ve seen in a U.S. airport.

Located past security and up several levels, the lounge is spacious, nicely lit and well-laid out in a linear fashion with each defined area dedicated to a different activity: eating, drinking, beavering away on a laptop, reading, watching TV, or sitting in a silent zone.

I was not traveling with a personal electronic device, so I especially appreciated that the Qantas/oneworld lounge offered no fewer than 19 free desktop PCs for the use of travelers.

In addition to large fleets of Airbus A320-family jets and Boeing 737NGs, Airberlin operates 13 Airbus A330-200 widebodies and two A330-300s. This photograph, taken at sunset, shows one of the carrier?s A330-200s landing

?

Airberlin flight AB 7023 took off on time. Glasses of complimentary champagne helped make take-off a jolly experience.

The two-class Airbus A330-200 had 20 Business Class seats in a 2-2-2 configuration, giving the cabin a cozy feel. Four flight attendants worked the space, imparting a cared-for quality. There were an additional 279 seats in Economy Class.

Airberlin does not rank among the industry?s innovators in seat technology but my Business Class seat proved more than adequate. The leather seats are 50 centimeters (19.7 inches) wide, 181 centimeters (72 inches) long and recline 170 degrees, backed with a hard shell. Seat pitch is 137 centimeters (53.9 inches).

A wide metal arm separates passengers in window and aisle seats. A personal, high-resolution, 8.9-inch touch screen offering games, movies, TV, music and a map showing progress of the aircraft pops out of the armrest and slides back. The meal table folds out of the top of the armrest. There is also a power socket for laptops.

These are what the Business Class seats look like on Airberlin?s Airbus A330-200s

?

Dinner was served shortly after takeoff on my 5:45 p.m. flight. In addition to its regular wine list, Air Berlin offers a small selection of wines from the restaurant Sansibar on the German island of Sylt in the North Sea.

I sipped one, a 2011 Kaapzicht Anna White, a refreshing South African blend of Chenin Blanc and Sauvignon Blanc, from the Stellenbosch wine region in the Cape Winelands. The young wine went well with my green salad with grilled potatoes, mixed vegetables and wedges of hardboiled egg.

For an entr?e, I had well-done ? but not over-done ? beef brisket in peppercorn sauce, with potato noodles and roasted carrots. I matched that with a 2006 Vincola Requense Polacio Crianza, a robust red wine from Spain, adroitly blended from Bobal, Tempranillo, Garnacha and Cabernet Sauvignon.

After dining, I read for a time, then slipped on high-quality Air Berlin headphones and listened to a mix of old favorites ? Dylan, Springsteen, the Who, the Kinks? ?Village Green Preservation Society? ? and new favorites Lady Gaga and the powerhouse British soul-singer Joss Stone.

In its long-haul Business Class cabins, Air Berlin offers food and wines from the restaurant Sansibar on the German island of Sylt in the North Sea. The wine choices from Sansibar are in addition to the airline?s main wine list

There are some 200 hours of entertainment programming on board in Business Class. The monitor includes a USB port. I snoozed for an hour or so, though legroom when the seat reclined was not abundant, until our on-time arrival.

Eight days later, on my return flight, AB 7022, I noticed the little things, nearly all of them done right. I dug into the amenity kit for ear plugs and an eyeshade and dabbed on the L?Occitane lip balm and face cream. I slipped on the black, Asian-style slippers, so much more comfortable than thin airplane socks worn by themselves.

I admired the smart flight attendant uniforms ? black, with red belts for the men and red scarves for the women. I was asked four times on the long return journey if I wanted to nosh or imbibe. I didn?t but I appreciated the non-intrusive solicitude of the staff.

The uniforms of Airberlin?s flight crews and cabin attendants are smart and stylish

Just before touch-down, a flight attendant asked, ?Mr. Armstrong, do you have a connecting flight??

?I do,? I said.

?Here is a bottle of water for the flight,? he said.

Little things mean a lot.
